Construction Site Stormwater Compliance: A Practical Guide

Stormwater compliance is a lifecycle responsibility — from pre-construction permitting through final stabilization and NOT filing — not a single checkbox at the start of a project.

Before Construction: Permitting and SWPPP Development

Compliance starts before the first shovel hits the ground — securing NPDES CGP coverage, developing a SWPPP that accurately reflects the planned BMPs, and confirming any additional local jurisdiction requirements that apply to the specific site.

During Construction: Installation, Inspection, and Maintenance

BMPs need to be installed to match the SWPPP, inspected on both a routine and post-rain-event schedule, and maintained as deficiencies are identified — with every step documented in a way that supports a regulatory review at any point in the project.

At Closeout: Final Stabilization and NOT Filing

Filing a Notice of Termination (NOT) under the NPDES CGP generally requires the site to have reached final stabilization — meaning incomplete or undocumented stabilization work can delay permit closeout even after construction itself is finished.

Throughout: Recordkeeping

A complete, organized inspection and maintenance record is often the difference between a routine regulatory review and a more difficult one — the work itself matters, but so does being able to demonstrate it was done.
