Federal Framework: NPDES
The National Pollutant Discharge Elimination System (NPDES) sets the federal framework requiring construction sites disturbing one or more acres to obtain permit coverage and implement a SWPPP with appropriate BMPs before, during, and after construction.
State Implementation: FDEP
In Florida, FDEP administers NPDES construction stormwater permitting through its Construction Generic Permit (CGP) program, and trains and certifies inspectors through the FSESCI program to evaluate whether site BMPs are installed and maintained correctly.
Local Layer: County and Municipal Requirements
Counties and municipalities frequently administer their own MS4 (Municipal Separate Storm Sewer System) permits and local stormwater review processes that sit on top of the state NPDES framework — meaning a project's actual BMP requirements are the combination of state permit conditions plus whatever the local jurisdiction requires for that specific site.
Why This Matters for Site Planning
A BMP plan that satisfies the state NPDES CGP in isolation may still fall short of local requirements if it doesn't account for jurisdiction-specific review — which is why experienced local BMP contractors who know the permitting environment in a given county add real value beyond simply installing generic erosion control.
