What is a Notice of Intent (NOI)?+

A Notice of Intent (NOI) is the application filed with FDEP to obtain coverage under the NPDES Construction Generic Permit (CGP) for a construction site disturbing one or more acres (or a smaller site that's part of a larger common plan of development). Filing the NOI is what formally puts a site under permit coverage — but it represents a certification that a Stormwater Pollution Prevention Plan (SWPPP) already exists for the site, not a standalone form.

What is a Notice of Termination (NOT)?+

A Notice of Termination (NOT) closes out NPDES CGP permit coverage once a project no longer needs it — generally once the site has reached final stabilization. Filing a NOT before final stabilization is reached can leave the project out of compliance even if construction itself has wrapped up.

When does NOI coverage need to be in place?+

Generally before land-disturbing activity begins on the site — not filed retroactively after grading has already started. Projects that change ownership or scope mid-construction may also need an updated or transferred NOI.

What has to exist before an NOI can be filed?+

A completed Stormwater Pollution Prevention Plan (SWPPP) identifying the BMPs that will control sediment and erosion throughout construction. An NOI filed without a real SWPPP behind it leaves the project exposed if a regulatory review happens early in construction.

Where are NOIs and NOTs actually filed?+

Through FDEP's NPDES stormwater permitting program. Always use FDEP's current official forms and portal rather than a third-party template, since requirements and forms can change.
