The Developer's Environmental Checklist for Florida Construction

The environmental requirements on a Florida construction project rarely stop the job on their own — they stop it when they're handled late. This checklist maps what belongs in each phase, from due diligence through closeout.

Why Environmental Items Belong on the Critical Path

On most Florida construction projects, the environmental scope is treated as a series of disconnected line items handed to whoever is cheapest at the moment they come due. That is exactly how they become expensive. A tree issue found during clearing, a SWPPP that doesn't match the field, or a failed inspection after the first big storm are not small problems — they are change orders, stop-work days, and permit findings.

Handled in sequence and ahead of the work they gate, the same items are routine. The checklist below groups the environmental scope by construction phase so nothing surfaces as a surprise on the critical path.

Phase 1 — Due Diligence & Preconstruction

Before capital commits and before the civil set is final, the environmental constraints on a parcel should already be understood. A tree inventory documents the number, species, size, condition, and disposition of the trees on site, which drives clearing limits, mitigation exposure, and site-plan review. Protected or specimen trees discovered after design is locked are one of the most common causes of expensive redesign.

This is also the phase to confirm the stormwater and permitting path: whether the project will disturb one or more acres and therefore need coverage under the FDEP NPDES Construction Generic Permit, and what local jurisdiction review applies. Identifying that early determines when a SWPPP has to exist and who certifies it.

Phase 2 — Permitting & SWPPP

For projects that trigger it, a site-specific SWPPP has to be prepared and coverage initiated — typically through a Notice of Intent (NOI) — before ground is broken. The SWPPP is not a filing-cabinet document; it defines the erosion and sediment control narrative, the BMP schedule, inspection requirements, and stabilization procedures the site will actually be held to.

The point of getting this right in Phase 2 is that the paperwork and the field plan have to match. A SWPPP written without regard to the real construction sequence produces a site where the installed controls don't match the document — which is exactly what a compliance inspection flags.

Phase 3 — Active Construction

Perimeter and inlet controls go in before mass grading, not after: silt fence trenched along the contour, inlet protection sized to each structure, and a stabilized construction entrance at the access point. Tree-protection barricades protect the trees the inventory identified for preservation.

Through the build, the compliance obligation is continuous. Routine and post-rain inspections keep the SWPPP record current, and maintenance — sediment removal, repairs, re-staking — keeps the controls functioning. Findings should be documented with corrective action tracked to close-out, so the compliance file is defensible if a regulator ever asks to see it.

Phase 4 — Stabilization & Closeout

As areas reach final grade, they have to be stabilized within the timelines the permit requires. Temporary controls are removed only once the site is permanently stabilized, and a Notice of Termination (NOT) closes out the permit coverage in an orderly, documented way.

A clean closeout matters beyond the permit: it protects the finished asset from erosion and drainage problems that surface after the crews leave, and it leaves an owner with a complete environmental record for the property.
